Competency aims

The course provides a managerial view to intellectual
property rights (IPRs) and contract practices in the media
industry.

Learning outcomes

At the end of the course, the student will understand:

What kinds of rights IP laws grant, how IPRs are obtained,
maintained, licensed and transferred, how IPRs expire and
exhaust, how IPRs can be challenged and revoked, and
how right holders can protect their IPRs

What kinds of moral and ethical concerns IPRs raise and
how IPRs can be used sustainably

How to draft business agreements

Course contents

The emphasis of the course lies in copyright, trademarks,
and the so-called software and business method patents.
In addition, course participants learn the basics of design,
domain name and database rights as well as human rights
and competition law in connection to IPRs.

The course deploys a crowdcreation approach requiring
students to take an active role in knowledge creation and
distribution. Students form 6 - 8 research project groups,
in conjunction of which, they specialise in an IPR topic.
The results of the research project are reported in a
research report and presented in a student-led seminar as
a mini-lecture. If students allow, their research reports
will be published and used as learning materials in the
future media law courses at Arcada. The research project
groups decide what kind of a publication and distribution
regime they subject their research reports to.

To pass the course the student should pass the following
examinations:

1. Assignment (Individual Assignment), 30 % of the
grade: Written report on the topic: “The Advantages and
Disadvantages of IP Protection In the Media Industry”

student’s own

2. Research Project (Group Assignment) consisting of a written
report (50 %) and a mini-lecture (20 %), constituting 70 % of the
grade, on a topic selected
from the list below (every group chooses a different topic):

1. A critical history of IP regulation and its impact on the
development of the media industry.

2. A short handbook of cyberlaw: What every website developer and
maintainer needs to know to minimise legal problems.

3. The role of IP protection in the commercial viability of video
games.

4. Creative Commons and open source licenses: A feasible
alternative to media firms?

5. Legal challenges of crowdcreation and crowdfunding in media
business.

6. When terms of use and privacy statements go beyond he limit of
acceptability? A case study of user agreements of online media
service providers.

7. Keyword advertising, fair competition and consumer rights: A
mismatch beyond repair?

8. A short handbook of international trade of media products: What
every sales manager needs to know about the cross-border sales of
IP
protected media goods.

9. How does web filtering work? A critical study on the methods and
consequences of web filtering technologies.

10. An analysis of a patent thicket in the IT industry and its impact
on industrial development.

11. Creative expression in programming: Why does software
deserve to be protected by copyright?
